BC Supreme Court Declares Provincial Sales Tax Unconstitutional (Sort Of)

In a decision rendered February 8th 2005, the British Columbia Supreme court ruled, in response to a constitutional challenge, that low income individuals do not have to pay the 7% special sales tax levied by the BC government on legal services.

For legal services rendered on or after February 8th 2005, lawyers are not required to collect and remit tax on legal services rendered to individuals whose incomes fall below the qualifying thresholds for access to Legal Aid.

GreenWay Legal Centre has established a protocol for identifying and assisting those of its clients who may benefit from this court decision, and has sent a rude letter to the government complaining about how silly the resulting situation is.

Heather Yemen, one of our longest serving staff members, participated in a six week expedition to the Holy city of Varansi, India. As a member of a team of 12 nursing students from Kwantlen University College, she offered nursing care in the form of health promotion, teaching and administering vaccinations.

In addition to her staff duties at GreenWay, Heather is a full time nursing student at Kwantlen University College.

March 2006 marked the two year anniversary of the coming into force of the BC Business Corporations act.

This is a significant anniversary for the owners of all incorporated businesses in British Columbia, since every corporation must take steps to become compliant with the new legislation or lose their corporate existence.

GreenWay Legal Centre acts for about 500 BC corporations and has made efforts to "transition" all of them to the new legislation, and to bring news of the required changes to those businesses who have been maintaining their own corporate records.
